    TERMS AND CONDITIONS

    AS Liviko processes the personal data submitted by the participant during the campaign in accordance with Regulation (EU) 2016/679 (GDPR) of the European Parliament and of the Council, the legislation of the Republic of Estonia, and these campaign terms for the purpose of conducting the campaign.

    By participating in the campaign, the participant gives AS Liviko consent to process the data submitted at registration for the following purposes:

    • registering and managing campaign participation;
    • verifying compliance with campaign terms;
    • identifying and notifying winners;
    • arranging the handover of prizes;
    • compiling summaries and statistics related to the campaign;
    • resolving possible disputes, complaints and legal claims.

    The first name and initial of the surname of winners will be published on the campaign website www.starterenergy.ee no later than the third working day following the draw.

    AS Liviko may share personal data with its partners and service providers (e.g. IT service provider, technical organiser of the draw, logistics and courier partners) to the extent necessary for conducting the campaign. These parties process data solely on AS Liviko’s instructions and in accordance with applicable data protection requirements.

    The legal basis for processing personal data is:

    • the participant’s consent to participate in the campaign;
    • AS Liviko’s legitimate interest in conducting the campaign, preventing misuse and protecting its rights;
    • compliance with legal obligations.

    Personal data collected during the campaign will be retained until 31.10.2026, unless longer retention is required to fulfil a legal obligation or resolve legal disputes.

    Campaign participants have the right to:

    • obtain information about the processing of their personal data;
    • request the correction or deletion of their data;
    • restrict the processing of personal data;
    • object to the processing of personal data;
    • withdraw consent, where processing is based on consent;
    • lodge a complaint with the Data Protection Inspectorate.

    The campaign runs from 01.07.2026 – 31.07.2026. The campaign applies only to purchases made at Olerex stores. All Starter drinks are included in the campaign. To participate, register your receipt at: www.starterenergy.ee. One receipt gives one entry into the draw. Multiple receipts may be registered.

    On 05.08.2026, 10 prizes will be drawn among all campaign participants:

    All persons registered online during the period specified in the campaign rules are eligible for the prize draw. Winners will be contacted using the contact details provided at registration. At least one representative of AS Liviko will be present at the draw.

    The winner’s name will be published at www.starterenergy.ee no later than the third working day following the draw. The organiser’s representative will contact the winner to confirm details and arrange delivery of the prize. If a winner cannot be reached within 7 days, AS Liviko’s representative has the right to draw a new winner.

    Participants must be at least 16 years of age. Those under 16 may participate only with the consent of a parent or guardian. AS Liviko employees and their family members may not participate. The participant is required to retain the registered receipt until the prize has been handed over. The organiser has the right to verify the winner’s identity and the existence of the receipt upon handover. Prizes cannot be exchanged for cash or other products. The organiser has the right to disqualify a participant suspected of violating the campaign terms, submitting false information or otherwise abusing the campaign. In the event of force majeure, AS Liviko has the unilateral right to amend the campaign terms, notifying participants on the campaign page.

    In the event of winning a prize, AS Liviko will publish the winner’s first name and initial of surname on the campaign website. The winner’s name, image, video or other personal data will be used in separate advertising or marketing materials only with the winner’s prior consent.

    AS Liviko may share participants’ personal data with partners and service providers (incl. IT service providers, technical draw partners, logistics and courier partners) to the extent necessary for conducting the campaign. These parties process data solely on AS Liviko’s instructions and in accordance with applicable data protection requirements.

    Taxes related to the handover of prizes to winners will be paid by AS Liviko in accordance with the legislation of the Republic of Estonia.

    All disputes arising from the campaign shall be resolved in accordance with the laws of the Republic of Estonia. All complaints regarding the organisation and/or conduct of the campaign must be submitted in writing to AS Liviko at: Masina 11, 10113 Tallinn, marked “KAMPAANIA” by 31.10.2026 at the latest. Complaints submitted after this date will not be processed. Received complaints will be responded to within 3 working days.     1. Kampaania (edaspidi Kampaania) on 01.05-30.09.2023 a toimuv tarbijamäng, mille korraldajaks on AS Liviko, Masina 11, 10144 Tallinn (edaspidi Kampaania Korraldaja).
    2. Kampaania läbiviimise kord on kehtestatud Kampaania Korraldaja poolt vastavalt käesolevatele tingimustele. Kõik Kampaania Korraldaja otsused kampaania läbiviimisel on lõplikud ning kõigile kampaanias osalejatele kohustuslikud. Kõik kampaaniast tulenevad vaidlused lahendatakse vastavalt Eesti Vabariigi seadusandlusele.
    3. Kampaanias võivad osaleda Eestis elavad vähemalt 16-aastased füüsilised isikud. Kampaanias ei või osaleda AS Selver ning AS Liviko töötajad ega nende perekonnaliikmed.
    4. Kampaanias osalemiseks tuleb tarbijal kampaaniaperioodil (01.05-30.09.2023) osta kauplustest ükskõik milline Starter energiajook ja registreerida ostutšekk Starteri kodulehel http://www.starterenergy.ee. Loosimises osalevad ainult korrektselt täidetud väljadega registreerimised. NB! Hoida alles ostutšekk, mis on tõestuseks ostu sooritamise kohta.
    5. Ühe ostu kohta saab ennast kampaanias osalejaks registreerida ainult üks kord.
    6. Kampaaniasse registreeritava ostutšeki kellaaeg peab olema varasem kui kampaaniasse registreerimise kellaaeg. Kampaanias osalevad ostutšekid, mis on alates 01.05.2023 kuupäevaga.
    7. Kampaania korraldaja loosib välja kampaaniasse registreerunute vahel:

    1. Kampaaniaauhindade loosimine toimub iga nädal. Peaauhind loositakse 1 oktoober 2023, vaheauhinnad 1tk Starter ralliraadio Makita DMR114, 1tk Starter multitööriist Leatherman Wingman, 1tk Starter Focus 12-pakk loositakse välja üks kord igas kampaaniakuus. Loosimises osalevad kõik osalejate poolt korrektselt täidetud andmetega (edaspidi: Andmed) ostutšekid, mis on registreeritud ametlikul kampaanialehel http://www.starterenergy.ee ajavahemikus 01.05.2023 kell 00:00 kuni 30.09.2023 kell 23:59.
    2. Auhinna lunastamiseks on vaja esitada registreeritud ostutšekk.
    3. Võitjate nimed avaldatakse starterenergy.ee/kampaanialehel. Võitjatega võetakse auhinna üleandmiseks personaalselt ühendust 3 tööpäeva jooksul pärast loosimist. Kampaania Korraldaja väljastab võite 1 kuu jooksul peale võidust võitjale teatamist.
    4. Võidetud auhinnad väljastatakse kampaanias loosimise võitnud isikule või volituse alusel tema esindajale isikut tõendava dokumendi esitamisel. Teovõimetu või piiratud teovõimega isiku poolt võidetud auhinnad antakse kätte tema seaduslikule esindajale. Võidud väljastab Liviko AS Cash&Carry kaupluses Lastekodu 45, Tallinn E-R 10.00-18.00.
    5. Kampaania Korraldaja tagab võitude väljastamise kuni 01.11.2023. Kui võitjaga ei ole õnnestunud selleks ajaks võitja süül kontakti saada või ei ole võitja oma korrektseid andmeid ja/või ostutšekki edastanud, siis tühistub võitjal õigus võidule.
    6. Kampaania Korraldajal on õigus kontrollida kampaaniatoodete ostu kinnitavate ostutšekkide õigsust. Ostutšekk on käesolevatele reeglitele mittevastav ja auhindade võitmiseks kehtetu juhul, kui see on omandatud ebaausal teel, selle märgistus on võltsitud, kopeeritud, lubamatult moonutatud või ükskõik millisel moel muudetud.
    7. Kampaania käigus osaleja poolt võidetud auhindu ei asendata võitja nõudmisel teist liiki auhindadega ega hüvitata auhinna võitjale auhinna maksumust rahas. Auhindade kättesaamisega seotud transpordikulusid vms kulutusi võitjale või tema esindajale ei hüvitata.
    8. Kampaanias osalemist loetakse ühtlasi ka loa andmiseks kampaania Korraldajale kasutada võitja nime Starteri sotsiaalmeedias ja üritustel ilma võitjale täiendavat tasu maksmata ja vastavat kokkulepet sõlmimata.
    9. Kampaania Korraldaja ei vastuta auhindade võitjatele ja/või auhindade kasutajatele auhindade kasutamisel tekkida võivate võimalike kulude ja kahjude eest. Kampaania Korraldaja ei vastuta auhindade võitjate ja/või auhindade kasutajate poolt auhindade kasutamisel kolmandatele isikutele tekitatud võimalike kahjude eest.
    10. Kampaanias osaleja poolt kampaania korraldamise tingimuste eiramise või kampaania Korraldajale enda kohta valede või ebatäpsete andmete esitamise korral, samuti muude ebaõnnestumiste korral, aga ka siis, kui Korraldajal ei õnnestu võitjaga kontakti saada (v. a kampaania Korraldaja süü tõttu), ei vastuta kampaania Korraldaja kampaanias osalejate auhindade loosimisest või auhindade kätteandmisest kõrvalejäämise eest.
    11. Kampaania Korraldajal on ühepoolne õigus katkestada kampaania ja lõpetada auhindade väljaandmine juhul, kui on rikutud reegleid, või vääramatu jõu (force majeure)asjaolude ilmnemisel, teatades sellest kohe kampaanias osalejatele massimeedia vahendusel.
    12. Kõik pretensioonid seoses kampaania korraldamise ja/või läbiviimisega tuleb esitada kirjalikult kuni 01.11.2023 Kampaania Korraldajale aadressil: AS Liviko, Masina 11, 10144 Tallinn või Liviko@liviko.ee märksõnaga “STARTER SUVEKAMPAANIA“. Pretensioonide esitamise tähtajast kinnipidamise tõestuseks on postitempli kuupäev. Pretensioonides peab olema toodud Osaleja ees- ja perekonnanimi, täpne aadress, ning võimalike puuduste ja põhjuste üksikasjalik kirjeldus.
    13. Kampaania Korraldaja vaatab pretensioonid läbi 7 tööpäeva jooksul alates kättesaamise kuupäevast ning teatab oma otsusest pretensiooni esitajale kirjalikult pretensioonis märgitud aadressil.

      1. The campaign (hereafter referred to as the Campaign) is a consumer game running from 1 May-30 September 2023 which is being organized by AS Liviko, Masina 11, 10144 Tallinn (hereafter referred to as the Campaign Organizer).
      2. The procedure for the conducting of the Campaign has been established by the Campaign Organizer in accordance with these terms and conditions. All decisions made by the Campaign Organizer in the course of running the Campaign are final and binding on all of the participants in the Campaign. Any disputes arising from the Campaign shall be resolved in accordance with the legislation of the Republic of Estonia.
      3. The Campaign is open to Estonian residents of at least 16 years of age. The Campaign is not open to employees of AS Selver or AS Liviko or their family members.
      4. In order to take part in the Campaign, a consumer must purchase any Starter energy drink from a store during the Campaign period (1 May-30 September 2023) and register their receipt on the Starter website (http://www.starterenergy.ee). Only those who register with all fields filled in correctly shall be entered in the prize draw. Note: Retain your receipt as proof of purchase.
      5. Participants can only register to take part in the Campaign once per receipt.
      6. The time on the receipt used to register for the Campaign must be earlier than the Campaign’s registration deadline. Receipts dated 1 May 2023 or later are eligible to take part in the Campaign.
      7. From among those registered, the Campaign Organizer shall draw as prizes.

      1. Prize draws shall be held each week; Main prize shall be drawn 1st of October, 1pc of rally radio Makita DMR114, 1pc of Starter multitool Leatherman Wingman, 1pc of Starter Focus 12-pack shall be drawn every campaign month. All receipts with details (hereafter referred to as Data) correctly filled in by participants and registered on the official website (http://www.starterenergy.ee) between 00:00 on 1 May 2023 and 23:59 on 30 September 2023 shall be entered in the prize draw.
      2. The original receipt must be presented upon claiming a prize.
      3. The names of the winners shall be published on the starterenergy.ee/kampaania page and on the Starter Facebook and Instagram pages @starterenergy. The winners shall be contacted personally within three working days of a draw in order to claim their prize. The Campaign Organizer shall issue the prizes within one month of notifying the winners.
      4. Each prize shall be issued to the individual who won it in the draw (or to their authorized representative) upon presentation of personal ID. Prizes won by individuals with restricted (or without any) active legal capacity shall be issued to their legal representative. The prizes can be claimed from the Liviko AS Cash&Carry store at Lastekodu 45 in Tallinn between 10:00 and 18:00 Monday-Friday.
      5. The Campaign Organizer shall guarantee the issuing of prizes until 1 November 2023. If a winner has not been able to be contacted by this time through the fault of the winner or the winner has not provided the correct Data and/or receipt, the winner’s right to the prize shall be invalidated.
      6. The Campaign Organizer has the right to check the authenticity of receipts submitted as confirmation of the purchase of campaign products. A receipt shall be deemed incompatible with these rules and invalid in terms of winning the prize if it was obtained by dishonest means, falsified, copied or modified, defaced or distorted in any other way that is not permissible.
      7. The prizes won by participants in the course of the Campaign shall not be exchanged for other prizes at the request of the winner or paid out as a cash equivalent. Any transport or other costs incurred by a winner or their representative in claiming a prize shall not be compensated.
      8. Taking part in the campaign shall be read as granting consent to the Campaign Organizer to use the winner’s name on Starter social media and at events without paying any additional fees to the winner or entering into an agreement in this regard.
      9. The Campaign Organizer shall not be liable for any costs or damage that may be incurred by the winners and/or users of the prizes in the use of the prizes. Nor shall the Campaign Organizer be liable for any damage caused to third parties by the winners and/or users of the prizes in the use of the prizes.
      10. In the event of a participant in the Campaign disregarding the terms and conditions of the Campaign or providing false or inaccurate Data about themselves to the Campaign Organizer, as well as in the event of other failures, including if the Campaign Organizer is unable to contact a winner (unless this is through the fault of the Campaign Organizer), the Campaign Organizer shall not be liable for participants in the Campaign being excluded from prize draws or from claiming prizes.
      11. The Campaign Organizer has the unilateral right to call a halt to the Campaign and to terminate the issuing of prizes in the event that the rules are broken or upon the emergence of circumstances of force majeure by informing the participants in the Campaign of this immediately via the mass media.
      12. Any and all complaints regarding the organization and/or conducting of the Campaign must be submitted to the Campaign Organizer in writing by 1 November 2023, addressed to AS Liviko, Masina 11, 10144 Tallinn or e-mailed to Liviko@liviko.ee and marked ‘STARTER SUVEKAMPAANIA’. The postmark shall serve as proof of submission prior to the deadline. Complaints must include the first name and surname of the participant, their exact address and a detailed description of the shortcomings or reasons behind their complaint.
      13. The Campaign Organizer shall review complaints within seven working days of their receipt and inform the individual who submitted the complaint of their decision in writing by sending it to the address marked in the complaint.
